1. LEGAL INFORMATION AND ACCEPTANCE<\/strong><\/p>\n

These provisions regulate the use of the Internet portal service (hereinafter, the ‘Portal’) provided by Summons Abogados (hereinafter, ‘Summons’) to Internet users.<\/p>\n

Summons Abogados, S.L.P., with registered office at C\/ Vel\u00e1zquez n\u00ba 92, 5\u00ba Derecha, Madrid 28006, and CIF: B-09834482, is a law firm that provides professional legal advisory services.<\/p>\n

Access to the website is free except for the cost of connecting through the telecommunications network supplied by the access provider contracted by users. Certain services are exclusive to our clients and access to them may be restricted. The legal services provided by Summons generally have a price indicated in the corresponding proposal for professional services.<\/p>\n

Use of the Portal implies the condition of user of the Portal (hereinafter, the ‘User’) and implies acceptance of all the conditions included in this Legal Notice. The provision of the Portal service is limited to the time the User is connected to the Portal or to any of the services provided through it. Therefore, the User must carefully read this Legal Notice on each occasion they intend to use the Portal, as it and its conditions of use as set forth in this Legal Notice may undergo modifications.<\/p>\n

Some Portal services accessible to Internet users or exclusive to Summons clients may be subject to specific conditions, regulations, and instructions that, where applicable, replace, supplement, and\/or modify this Legal Notice and must be accepted by the User before starting the provision of the corresponding service.<\/p>\n

2. INTELLECTUAL AND INDUSTRIAL PROPERTY<\/strong><\/p>\n

All contents of the Portal, including but not limited to texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound contents, as well as their graphic design and source codes (hereinafter, the ‘Contents’), are intellectual property of Summons or third parties, and no exploitation rights recognized by current intellectual property legislation are understood to be transferred to the User, except those that are strictly necessary for the use of the Portal.<\/p>\n

Trademarks, trade names, or distinctive signs are owned by Summons or third parties, and access to the Portal cannot be construed as granting any rights over the aforementioned trademarks, trade names, and\/or distinctive signs.<\/p>\n

\n

3. CONDITIONS OF USE OF THE PORTAL<\/strong><\/p>\n

3.1. GENERAL<\/p>\n

The User undertakes to make correct use of the Portal in accordance with the Law and this Legal Notice. The User will be liable to Summons and the lawyers working under this brand or to third parties for any damages and losses that may arise as a result of breach of said obligation.<\/p>\n

The use of the Portal for purposes detrimental to the assets or interests of Summons or third parties, or in any way that may overload, damage, or disable the networks, servers, and other computer equipment (hardware) or computer products and applications (software) of Summons or third parties is expressly prohibited.<\/p>\n

3.2. CONTENTS<\/p>\n

The User agrees to use the Contents in accordance with the Law and this Legal Notice, as well as with other conditions, regulations, and instructions that may be applicable in accordance with Clause 1. By way of example, the User, in accordance with current legislation, must refrain from:<\/p>\n

Reproducing, copying, distributing, making available, publicly communicating, transforming, or modifying the Contents except in cases authorized by law or expressly consented to by Summons or by the owner of the exploitation rights, as applicable.<\/p>\n

Reproducing or copying for private use any Contents that may be considered Software or Database under current intellectual property legislation, as well as their public communication or making available to third parties when these acts necessarily imply reproduction by the User or a third party.<\/p>\n

Extracting and\/or reusing all or a substantial part of the Contents comprising the Portal as well as the databases that Summons makes available to Users.<\/p>\n

3.3. DATA COLLECTION FORMS<\/p>\n

Without prejudice to the provisions of the privacy policy accessible from the Portal, the use of certain services or requests directed to Summons is conditioned upon prior completion of the corresponding User registration.<\/p>\n

All information provided by the User through the Portal forms for the aforementioned purposes or any others must be truthful. To this end, the User guarantees the authenticity of all data communicated and will keep the information provided to Summons perfectly updated so that it always corresponds, at all times, to the real situation of the User. In any case, the User will be solely responsible for any false or inaccurate statements made and for any damages caused to Summons or third parties by the information provided.<\/p>\n

3.4. INTRODUCTION OF LINKS TO THE PORTAL<\/p>\n

Internet users wishing to introduce links from their own web pages to the Portal must comply with the following conditions, without the lack of knowledge thereof exempting them from the responsibilities derived from the Law:<\/p>\n

The link will only link to the home page or main page of the Portal but may not reproduce it in any form (inline links, copying texts, graphics, etc.).<\/p>\n

It will be strictly prohibited, in accordance with the applicable and current legislation at any given time, to establish frames or frames of any kind that wrap around the Portal or allow the visualization of the Contents through Internet addresses other than those of the Portal and, in any case, when they are displayed together with contents not belonging to the Portal in a way that: (I) causes, or may cause, error, confusion, or deception among users about the true origin of the service or Contents; (II) constitutes an act of unfair comparison or imitation; (III) serves to exploit the reputation of the Summons brand and prestige; or (IV) is in any other way prohibited by current legislation.<\/p>\n

No false, inaccurate, or incorrect statements will be made on the page that introduces the link about Summons, its partners, employees, clients, or about the quality of the services it provides.<\/p>\n

Under no circumstances will it be stated on the page where the link is located that Summons has consented to the insertion of the link or that it otherwise sponsors, collaborates, verifies, or supervises the sender’s services.<\/p>\n

The use of any denominative, graphic, or mixed trademark or any other distinctive sign of Summons within the sender’s page is prohibited except in cases permitted by law or expressly authorized by Summons, and in these cases, a direct link to the Portal is allowed in the manner established in this clause.<\/p>\n

The page establishing the link must fully comply with the law and may not, in any case, contain or link to its own or third-party content that: (I) is unlawful, harmful, or contrary to morals and good customs (pornographic, violent, racist, etc.); (II) induces or may induce the User to the false conception that Summons subscribes to, endorses, adheres to, or in any way supports the lawful or unlawful ideas, statements, or expressions of the sender; (III) is inappropriate or irrelevant to Summons’ activity considering the place, contents, and theme of the sender’s website.<\/p>\n

4. DISCLAIMER<\/strong><\/p>\n

4.1. OF INFORMATION<\/p>\n

Access to the Portal does not imply any obligation on the part of Summons to verify the truthfulness, accuracy, suitability, adequacy, completeness, and timeliness of the information provided through it. The contents of this page are of a general nature and do not constitute, in any way, the provision of legal or tax advisory services of any kind, so such information is insufficient for making personal or business decisions by the User.<\/p>\n

Summons is not responsible for decisions made based on the information provided on the Portal or for damages and losses caused to the User or third parties due to actions based solely on the information obtained on the Portal.<\/p>\n

4.2. OF SERVICE QUALITY<\/p>\n

Access to the Portal does not imply any obligation on the part of Summons to control the absence of viruses, worms, or any other harmful computer elements. It is the User’s responsibility, in any case, to have adequate tools for detecting and disinfecting harmful computer programs.<\/p>\n

Summons is not responsible for damages caused to the computer equipment of Users or third parties during the provision of the Portal service.<\/p>\n

4.3. OF SERVICE AVAILABILITY<\/p>\n

Access to the Portal requires services and supplies from third parties, including transport through telecommunications networks whose reliability, quality, continuity, and operation are not the responsibility of Summons. Therefore, services provided through the Portal may be suspended, canceled, or rendered inaccessible, either prior to or simultaneously with the provision of the Portal service.<\/p>\n

Summons is not responsible for damages of any kind caused to the User resulting from failures or disconnections in telecommunications networks that lead to the suspension, cancellation, or interruption of the Portal service during its provision or beforehand.<\/p>\n

4.4. OF CONTENTS AND SERVICES LINKED THROUGH THE PORTAL<\/p>\n

The service of access to the Portal includes technical linking devices, directories, and even search instruments that allow the User to access other Internet pages and portals (hereinafter, ‘Linked Sites’). In these cases, Summons acts as a provider of intermediation services in accordance with article 17 of Law 34\/2002, of July 12, on Information Society Services and Electronic Commerce (‘LSSI’) and will only be responsible for the contents and services provided on Linked Sites to the extent that it has effective knowledge of their unlawfulness and has not diligently deactivated the link. In the event that the User considers that there is a Linked Site with unlawful or inappropriate content, they may notify Summons in accordance with the procedure and effects established in clause 5, without this communication in any case implying the obligation to remove the corresponding link.<\/p>\n

Under no circumstances does the existence of Linked Sites presuppose the existence of agreements with the responsible parties or owners thereof, nor the recommendation, promotion, or identification of Summons with the statements, contents, or services provided.<\/p>\n

Summons is not aware of the contents and services of Linked Sites and therefore is not responsible for damages caused by unlawfulness, poor quality, obsolescence, unavailability, error, or uselessness of the contents and\/or services of Linked Sites, nor for any other damage that is not directly attributable to Summons.<\/p>\n

<\/strong><\/p>\n

5. COMMUNICATION OF ILLEGAL OR INAPPROPRIATE ACTIVITIES<\/strong><\/p>\n

In the event that the User or any other Internet user becomes aware that Linked Sites lead to pages whose contents or services are unlawful, harmful, denigrating, violent, or contrary to morals, they may contact Summons indicating the following:<\/p>\n

Personal data of the communicator: name, address, telephone number, and email address;<\/p>\n

Description of the facts revealing the illegal or inappropriate nature of the Linked Site;<\/p>\n

In the event of violation of rights, such as intellectual and industrial property, personal data of the holder of the infringed rights when different from the communicator. Likewise, the title proving the legitimacy of the rights holder and, where appropriate, the representation to act on behalf of the holder when different from the communicator should be provided;<\/p>\n

Explicit statement that the information contained in the claim is accurate.<\/p>\n

Receipt by Summons of the communication provided for in this clause will not imply, according to the provisions of the LSSI, effective knowledge of the activities and\/or contents indicated by the communicator.<\/p>\n

Likewise, the title proving the legitimacy of the rights holder and, where appropriate, the representation to act on behalf of the holder when different from the communicator should be provided.<\/p>\n

6. LEGISLATION<\/strong><\/p>\n
